Trusted Estate Agents Spain is an open online review platform that connects consumers with estate agents in Spain. Our mission is to provide a transparent, open environment where users can share experiences with estate agents, thus helping others make informed decisions. By accessing or using our platform, you agree to comply with and be bound by the following terms of use (“terms”). If you disagree with any part of these terms, please do not use our platform.
These terms also incorporate the following policies, which apply when using our platform:
Throughout these terms, “you” or “your” refers to the person accessing or using our platform. “Trusted Estate Agents Spain”, “we”, “our”, or “us” refers to Anthony Spencer Rose, the owner and operator of the Trusted Estate Agents Spain platform.
To leave a review, like, or comment on our platform, you must create a user account. Each user is permitted only one personal account, and your user account must not be transferred to anyone else. Your account is personal, and you are responsible for maintaining the confidentiality of your login details. You agree to notify us immediately at info@trustedestateagentsspain.com if you believe your account has been compromised.
When creating an account, you agree to provide accurate and complete information about yourself. You also agree to keep your information up to date. We reserve the right to refuse registration or terminate accounts that we suspect are being used for fraudulent or improper purposes.
When creating, submitting, posting, or displaying user generated content on our platform, you retain ownership of that content. However, by posting on our platform, you agree that this content is your sole responsibility and that Trusted Estate Agents Spain does not endorse or accept any liability for user-generated content. You must ensure that your content is lawful, respectful, and compliant with these terms. Trusted Estate Agents Spain reserves the right to remove any UGC that violates these terms, our Guidelines for Reviewers, or applicable laws. By submitting UGC, you warrant that:
Any opinions, advice, statements, or other information provided in UGC are those of the authors and not of Trusted Estate Agents Spain. We do not guarantee the accuracy, integrity, or quality of any UGC, and you acknowledge that you may be exposed to content that you find objectionable.
Trusted Estate Agents Spain acts solely as an intermediary hosting user-generated content and does not assume any responsibility for monitoring the content posted by users. Trusted Estate Agents Spain shall not be held liable for any claims, legal proceedings, damages, or penalties arising from user-generated content. Users are solely responsible for their submissions, and by using the platform, you agree that you will not hold Trusted Estate Agents Spain liable in any way for any legal consequences resulting from UGC. We are not responsible for moderating or verifying user content and provide no warranties regarding its legality or appropriateness.
Our platform is open to the public, and estate agents listed on our platform may claim their listing to manage their profile and respond to reviews. However, once a listing is created, it cannot be removed from the platform at the request of the estate agent. This policy ensures that the information available remains transparent and accessible to all users, fostering a comprehensive and unbiased review environment.
By submitting UGC, you grant Trusted Estate Agents Spain a perpetual, non-exclusive, royalty-free, worldwide licence to use, display, modify, distribute, and reproduce your content for promotional, informational, or operational purposes. You agree that we may share or republish your content across our social media channels, website, and other marketing materials without further consent or compensation.
We retain ownership of all elements of our platform, including trademarks, design, and look and feel, excluding any UGC. You must not copy, distribute, modify, or use any content from our platform without our express permission. Unauthorized use of our platform may give rise to a claim for damages and/or be a criminal offense.
By submitting UGC, you grant Trusted Estate Agents Spain a non-exclusive, royalty-free, worldwide licence to use, display, modify, or distribute your content for promotional and operational purposes. However, we make no claim of ownership over your original content. You are solely responsible for protecting your intellectual property rights in your content.
Trusted Estate Agents Spain offers an “as is” platform without any warranties, guarantees, or conditions of any kind. The platform is subject to availability, and we cannot guarantee uninterrupted or error-free access. To the fullest extent permitted by law, our liability to you is limited to €100. Trusted Estate Agents Spain does not accept liability for any loss or damage of any kind arising from the use of our platform, including, but not limited to:
We are not responsible for verifying the identity of users or ensuring that user-generated content complies with these terms. You use the platform at your own risk and are solely responsible for your interactions with other users. Trusted Estate Agents Spain expressly disclaims all liability for user-generated content and any actions, proceedings, or legal claims arising from such content. By using the platform, you acknowledge that Trusted Estate Agents Spain shall not be held liable for any defamatory, offensive, or illegal conduct of any user or third party.
We may suspend or terminate your user account without notice if you breach any of these terms, our Guidelines for Reviewers, or applicable laws. We may also suspend or terminate your account if we suspect fraudulent activity, misuse of the platform, or any behavior that could negatively impact Trusted Estate Agents Spain or other users. You are free to delete your account at any time, in which case all your submitted content will be permanently removed from our platform, subject to our data retention policies.
These terms are governed by the laws of Spain. Any disputes arising in connection with these terms will be subject to the exclusive jurisdiction of the courts of Valencia, Spain. If any provision of these terms is found to be unlawful, void, or unenforceable, the remaining provisions will remain in full force and effect.
In case of disputes, we strongly encourage you to contact us first at info@trustedestateagentsspain.com to seek a mutually satisfactory resolution. We are committed to resolving disputes amicably and efficiently. If an agreement cannot be reached, the parties agree that the competent courts of Valencia, Spain, shall have exclusive jurisdiction to settle the matter.
Furthermore, if you are using the platform as a consumer, you may also have the right to bring claims before the courts of your country of residence, depending on applicable consumer protection laws. The provisions of this section do not affect your statutory rights as a consumer.
We may modify these terms at any time without prior notice. It is your responsibility to regularly review these terms to ensure that you are informed of any changes. Continued use of the platform after changes are made will constitute your acceptance of the revised terms.
